You agree that any mediation will be conducted on an individual basis and not as a class, consolidated, or representative action. You further agree that the mediator may not consolidate more than one person’s claims or preside over any form of a representative or class proceeding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief to protect their intellectual property rights in any court of competent jurisdiction.
